XTicker terms of use

Acceptance

By downloading, installing or using XTicker, you agree to these terms. If you don't agree, don't use the app. No account or click-through agreement is needed beyond this page.

License

XTicker is provided free of charge and supported by optional tips. You are granted a personal, non-exclusive, non-transferable license to install and use the app on Macs you own or control. You may not resell it, redistribute it as your own, or remove or alter its branding.

No warranty

XTicker is provided "as is" and "as available," without warranty of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose or non-infringement. Use of the app is entirely at your own risk. We do not guarantee that XTicker will be error-free, uninterrupted, secure, or compatible with every Mac, display, macOS version or other app, including future updates to macOS that may change how it behaves.

Limitation of liability and assumption of risk

To the fullest extent permitted by law, Hit the Deck Software and the developers of XTicker are not responsible or liable for any damage to your Mac or other systems, loss or corruption of data, loss of profits or business, interruption of service, or any other direct, indirect, incidental, special, consequential or exemplary damages arising from your use of, or inability to use, the app or this website, even if we have been advised of the possibility of such damages. You are responsible for backing up anything important on your Mac. If the law where you live does not allow some of these limits, they apply only as far as the law permits.

Information shown is not advice

The ticker displays information from third-party sources that we do not control, including stock quotes, news, sports scores, tides, air quality, sun and moon times, aircraft positions and horoscopes. It may be delayed, incomplete, inaccurate or unavailable. Nothing in XTicker is financial, investment, legal, medical, safety or navigation advice. Do not rely on it for trading or investment decisions, for navigation, for aviation, or for health or safety decisions. Always check the original source.

Your responsibility

You are responsible for complying with the terms of the services and publishers whose content you choose to display, including any RSS feeds you add, and for the permissions you grant to XTicker in macOS.

Tips

XTicker is free to use in full. Tips made through Buy Me a Coffee are voluntary and non-refundable, and do not create any support contract, service-level agreement or ownership stake in the software.

Third-party trademarks

Apple, Mac, macOS, iTunes, Windows, Nasdaq, ESPN, NOAA, Wikipedia, Spotify and all other names and marks mentioned are trademarks of their respective owners. The Windows 95, iTunes LCD and Mac OS 9 Control Strip themes are original visual homages. XTicker is an independent product and is not affiliated with, endorsed by or sponsored by any of them. The Crimson Alloy theme uses the Orbitron font by the Orbitron Project Authors, licensed under the SIL Open Font License 1.1.

Changes and termination

We may change, discontinue or stop supporting XTicker at any time, for any reason, without notice. It is maintained on a best-effort basis. We may update these terms from time to time, and continued use of the app after an update means you accept the revised terms.
